This Agreement (“Agreement” or “Terms”) is entered into by and between The Free Website Guys UK (“Company,” “we,” “us,” or “our”), and you, the individual or entity accessing the website or engaging with our services (“Client,” “you,” or “your”).
These Terms govern your use of our website, any services rendered by the Company (whether complimentary or paid), and any interactions, transactions, or engagements resulting therefrom. By using our website or accepting services from us, you agree to be bound by these Terms.
1. Scope of Services Covered
These Terms apply to all services and products provided by the Company, including but not limited to: complimentary website development, paid services, design work, hosting or theme referrals, subscription plans, and related deliverables. These Terms govern your use of such services whether they are provided at no cost or purchased directly from the Company.
Development Hours: pre-paid or complimentary blocks of service time. Complimentary Services: any service provided at no monetary charge. Paid Services: any service purchased for a fee. Affiliate Link: a unique URL that credits the Company with a commission.
2. Complimentary Services and Affiliate Requirements
The Company may, at its sole discretion, offer certain services—such as initial website setup—on a complimentary basis. These services are provided as a courtesy and may be modified or revoked at any time.
To receive complimentary services, you may be required to sign up for web hosting through an Affiliate Link. In compliance with UK consumer protection regulations, we disclose that we may earn a commission from this link, which helps offset the cost of building your website.
You acknowledge that access to our complimentary services may be conditioned upon the use of said affiliate link. If you cancel or switch the third-party web-hosting service in a way that results in the Company losing its affiliate compensation, the Company reserves the right to terminate services.
3. Ownership and Intellectual Property
All assets specifically created for your use—including website files, custom graphics, and code snippets—shall be your exclusive property upon completion of services, provided all conditions of this Agreement have been met.
The Company retains all rights to any proprietary tools, templates, or reusable components not specifically created for your project. You agree not to replicate or reverse-engineer the Company’s business model or offerings.
4. Data and Information Security
You are solely responsible for the protection and security of all information associated with your accounts, including login credentials and personal data. While we implement commercially reasonable safeguards, the Company shall not be liable for any damages arising from security breaches, hacking, or failures of third-party platforms.
5. Limitation of Liability
To the maximum extent permitted by UK law, in no event shall The Free Website Guys UK or its staff be liable for any indirect, incidental, or consequential damages, including loss of profits, revenue, or business opportunities.
In all cases, the Company’s total cumulative liability for any claim related to this Agreement shall not exceed two hundred fifty pounds sterling (£250 GBP).
6. Confidentiality
Both parties agree to protect non-public, proprietary information disclosed during the course of engagement. This includes business strategies, internal processes, and lead data. This obligation remains in effect indefinitely.
7. Billing and Cancellations
Subscription fees recur on the same day each billing cycle. You may cancel by emailing [email protected] prior to your next billing date. All sales and subscriptions are final and non-refundable.
Chargebacks: You agree to contact the Company in good faith before initiating any payment dispute. Unannounced chargebacks constitute a material breach of this Agreement.
8. Governing Law and Jurisdiction
This Agreement shall be governed by the laws of England and Wales. You consent to the exclusive jurisdiction of the courts of England and Wales for any disputes arising out of or relating to this Agreement.
